These Terms of Service ("Terms") are a legal agreement between you and Kenbright Insurance Brokers Limited ("Kenbright", "we", "us", "our") governing your use of the Kenbright website (`kenbright.africa`), the Kenbright App, and the Kenbright Individual Provident Fund online application (together, our "Services"). By accessing or using our Services, you agree to these Terms. If you do not agree, do not use them.
1. Who we are
Our website, app and the Kenbright Individual Provident Fund online application are operated by Kenbright Insurance Brokers Limited, a licensed insurance brokerage regulated by the Insurance Regulatory Authority (IRA) of Kenya (licence no. IRA/06/347/2026). We are part of Kenbright Holdings Limited (KHL), a leading East African insurance and financial services group with over 30 years' experience, headquartered in Nairobi with offices in Uganda and Tanzania.
Across our Services we offer, and provide information about, a range of services — insurance (motor, health/medical, travel and other retail and corporate cover), pensions, employee benefits, investments, reinsurance, and actuarial and advisory services. Some of these are provided together with other companies in the Kenbright group under their applicable regulators.
We are also the administrator, as recorded by the Retirement Benefits Authority (RBA), of the Kenbright Individual Provident Fund ("the Fund") — an RBA-approved individual retirement savings scheme, approved to receive NSSF Tier 2 contributions under Scheme Reference Certificate no. RBA/RSC/0443. Section 6 governs the Fund's online application service and your membership.
Where you buy insurance, Kenbright is your broker, not the insurer. The cover itself is provided and underwritten by third-party insurers regulated by the IRA. Your policy with an insurer is governed by that insurer's own policy documents, terms, exclusions and premium.
2. Using our Services
- Our website is open for you to browse for general information. Buying and managing cover, and some features, are provided through the Kenbright App and require an account.
- The Kenbright Individual Provident Fund online application is open to prospective members and does not need a Kenbright App account; section 6 governs it.
- You must be at least 18 years old and legally able to enter into contracts to buy a product or open an account.
- You must give accurate, complete and current information, and keep it up to date. Insurance decisions and pricing depend on it — incorrect or withheld information can void your cover or a claim.
- You are responsible for your login credentials and for all activity under your account. Keep them secret. Tell us immediately at [email protected] if you suspect unauthorised access.
- In the app you may enable biometric (fingerprint/face) unlock for convenience; this uses your device's own security and your biometric data never leaves your device.
3. Information on our website is not advice
Much of our website provides general information about insurance, pensions, investments, employee benefits and related services. This information is for general guidance only. It is not professional, financial, actuarial, investment, tax or legal advice, and is not an offer or recommendation to buy any particular product.
Pensions and investments carry risk: their value can go down as well as up, and past performance is not a guide to future results. Before acting on anything you read here, obtain advice suited to your own circumstances. Where you engage us for a specific broking, advisory, pensions or investment service, that service is governed by the separate agreement and disclosures we provide for it, which prevail over these Terms for that service. For the Kenbright Individual Provident Fund, that framework is the Fund's Trust Deed and Rules — see section 6.
4. Quotes, policies and payments
- Quotes are indicative and depend on the information you provide and the insurer's acceptance. A quote is not an offer of cover and may change or expire.
- Cover starts only when the insurer accepts the risk, your premium (or the agreed first instalment) is received and confirmed, and you receive a confirmation or certificate.
- Premiums, levies and taxes (including any IRA and statutory levies and applicable taxes) are shown before you pay. Payments are processed through regulated providers such as M-PESA and card processors.
- Renewals, cancellations and refunds are governed by section 7 below and the terms of the specific policy.
- You are responsible for reading your policy documents, including cover limits, excesses and exclusions.
5. Claims
You can file and track claims in the app, including by uploading photos and documents. Claims are assessed and settled by the insurer according to your policy. Giving false or misleading information in a claim is fraud, may void your cover, and may be reported to the authorities.
6. Kenbright Individual Provident Fund
This section governs the Fund's online application service and the membership that follows from it. Where it conflicts with another section of these Terms, this section prevails for the Fund.
6.1 The service. The online application lets prospective members apply to join the Kenbright Individual Provident Fund, an RBA-approved retirement savings scheme approved to receive NSSF Tier 2 contributions under Scheme Reference Certificate no. RBA/RSC/0443. Kenbright operates it as the Fund's administrator as per RBA records. Submitting an application does not by itself create membership — membership takes effect only when your application is approved in accordance with the Fund's Trust Deed and Rules.
6.2 Your responsibilities. You must:
- provide information that is true, complete and accurate, and, when asked after enrolment, upload a genuine copy of your own ID or passport;
- keep your private application resume link confidential — anyone with the link can view and edit your draft application;
- be at least 18 years old and legally capable of entering into this application.
6.3 Declarations and authorisations. The confirmations you give in the application — including the beneficiary nomination authorisation and the final declaration — have the same effect as a signed declaration on the Fund's paper application form.
6.4 Contributions. Contributions are made via the Fund's M-PESA Paybill or bank account shown on the site. No payments are collected through this service itself.
6.5 Email and telephone instructions, and indemnity. Kenbright is not obliged to accept and act on instructions that come from your email address or telephone number. Notwithstanding that, by submitting an application through this service you authorise Kenbright to act on instructions transmitted via the email address and telephone number you provide in your application.
You agree to indemnify Kenbright against any loss incurred as a result of Kenbright acting on, or declining to act on (wholly or in part), instructions which Kenbright believes in good faith to have been given in conformity with the above, whether or not such instructions were in fact so given. The fact that any instruction may later be shown to be in any way false, incomplete, inaccurate, delayed, erroneous, unauthorised or otherwise not authentic shall not be an impediment to the rights of Kenbright under this indemnity.
6.6 Keeping your contact details current. Please ensure the email address and mobile number in your application remain current. Notify the pension team promptly at [email protected] of any change, so that communications about your application and membership reach you safely.
6.7 Governing framework. Once approved, your membership is governed by the Fund's Trust Deed and Rules, the Retirement Benefits Act, and other applicable Kenyan law. In the event of any conflict between these Terms and the Trust Deed and Rules, the Trust Deed and Rules prevail.
6.8 Confidentiality. We treat your personal information as private and confidential, in line with our Privacy Policy, and disclose it only to the Fund and other permitted parties, or where we are legally compelled to do so.
7. Cancellation, renewals and refunds
Cancellation and refund rules are set by the insurer and differ from product to product. There is no single Kenbright-wide refund rule. Before you cancel or expect a refund, read your policy document, and for any cancellation or refund request you must contact our underwriting team at [email protected] — this is the only channel through which cancellations and refunds are handled. Requests made any other way may not be actioned. Kenbright Individual Provident Fund queries are the exception: send those to [email protected], and see the pensions bullet below.
How the rules differ by product (illustrative — your policy governs):
- Motor — cancellation usually requires the return of the certificate of insurance and, where issued, the digital/printed cover note. Refunds, if any, are typically calculated on the insurer's short-period ("short-rate") scale, not pro-rata, and no refund is due once a claim has been made in the policy period.
- Health / medical — often has a limited cooling-off period after which the premium may be non-refundable, or refundable only on a pro-rata basis less any claims paid or services used. Family/dependant cover may have its own rules.
- Travel — frequently non-refundable once the policy is issued or once the covered trip has begun, given the short duration and immediate cover.
- Pensions and investments — governed by the scheme's or product provider's rules and applicable law (including contribution, vesting, withdrawal, transfer and surrender terms); amounts returned are determined by the scheme or provider, not by Kenbright. For the Kenbright Individual Provident Fund, contributions are not "refunded" on request: benefits, transfers and withdrawals are payable only as the Fund's Trust Deed and Rules and the Retirement Benefits Act allow (see section 6). - Roadside / garage and other services — governed by the specific service provider's terms.
Statutory levies and taxes (such as IRA and other regulatory levies and applicable taxes) are generally non-refundable regardless of product.
Kenbright's role and limitation of liability. Kenbright acts only as your broker to pass your request to the insurer or provider and to facilitate any refund the insurer or provider approves. (For the Kenbright Individual Provident Fund we act as the scheme's administrator rather than as a broker; benefits and payments are determined by the trustees under the Trust Deed and Rules.) We do not set, guarantee, or advance refund amounts, and we are not liable for an insurer's or provider's decision to grant, reduce, delay or decline a cancellation or refund, or for how they calculate it. Any refund is paid on the insurer's or provider's terms and timelines, through the original payment method where possible. This does not affect any right you have that cannot be excluded by law.
8. If you use the app as an agent
If your account is enabled for agent use, you additionally agree that: you will only sell products you are authorised to sell; you will represent them and Kenbright honestly and comply with all IRA and consumer-protection rules; you will protect the personal data of the clients you serve in line with our Privacy Policy and the Data Protection Act, 2019; and commissions are attributed and paid according to your separate agreement with us. We may suspend agent access for conduct that breaches these Terms or the law.
9. Acceptable use
You agree not to:
- use our Services for any unlawful, fraudulent or misleading purpose;
- submit false information, or impersonate another person;
- interfere with, disrupt, reverse-engineer, decompile or attempt to gain unauthorised access to our Services or their systems;
- upload malware, or scrape or harvest data from our Services;
- use our Services in a way that infringes anyone's rights or breaches any law.
We may suspend or close accounts, or restrict access, where these Terms are breached.
10. Third-party services, links and content
Our Services connect you with, and may link to, third parties — insurers, payment providers, garages, medical schemes, group companies and other websites. Their services and websites are governed by their own terms, and we are not responsible for their content, acts or omissions, though we will help you where we reasonably can. Following an external link is at your own risk and subject to that third party's terms.
11. Intellectual property
Our website, the app, their content, branding ("Kenbright", "Kenbright App", "Kenbright Holdings") and software are owned by us, our group companies or our licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use our Services for their intended purpose. You may not copy, modify, distribute or create derivative works from them without our written permission.
12. Availability
We work to keep our Services available and accurate, but we do not guarantee they will always be uninterrupted or error-free. We may update, suspend or withdraw features, and we may perform maintenance, without notice.
13. Disclaimers and liability
Our Services, and the information on them, are provided "as is". We do not warrant that information on the website is complete, current or error-free. To the maximum extent permitted by law, we are not liable for: indirect or consequential loss; loss arising from reliance on general website information (see section 3); loss arising from information you provided that was inaccurate or incomplete; the acts, omissions, or the acceptance or rejection of cover, claims, cancellations or refunds by an insurer or other third party; or events outside our reasonable control.
Nothing in these Terms limits any liability that cannot be limited by law, including our duties to you as your licensed insurance broker.
14. Termination
You may stop using our Services and close your account at any time (see Account & data deletion in our Privacy Policy). We may suspend or terminate your access if you breach these Terms or the law. Provisions that by their nature should survive (including sections 3, 6.5, 11, 13, 15 and 16) survive termination. Closing your account does not cancel any live insurance policy, and does not end your membership of the Kenbright Individual Provident Fund — see sections 6 and 7 and contact [email protected] (or [email protected] for the Fund) to manage that separately.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Kenya (and, for products or services provided in another country we serve, that country's applicable law). We would like to resolve any issue with you directly — please contact [email protected] first. Disputes that cannot be resolved are subject to the exclusive jurisdiction of the Kenyan courts, without prejudice to any complaint you may raise with the IRA, the RBA or the ODPC.
16. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new "last updated" date and, for significant changes, notify you in the app or on the website. Continuing to use our Services after a change means you accept the updated Terms.
